Chapter I. General Provisions
Article 1. General Provisions
- This Regulation defines the legal status, objectives, functions, structure, and accountability of the Legal Department (hereinafter referred to as the Department) of the LEPL State University of Physical Education and Sport of Georgia (hereinafter referred to as the University), and regulates other issues related to its activities.
- The Department is a structural unit of the University’s administration, guided in its activities by the legislation of Georgia, the legal acts of the University, and this Regulation.
- Within its competence, the Department performs tasks assigned by the University Rector and Head of Administration based on legislation, and is accountable to them.
Chapter II. Scope of Activity, Objectives, and Functions of the Department
Article 2. Scope of Activity, Main Objectives, and Functions of the Department
- The scope of activity, functions, and objectives of the Department are:
- To participate in the development of drafts of the University’s legal acts within its competence and, if necessary, to facilitate the procedures for their submission in accordance with the law;
- To carry out legal expertise and endorsement of drafts of legal acts developed and submitted by the University and other bodies, organizations, and institutions within its competence, and/or to prepare conclusions based on legal expertise regarding these drafts;
- To prepare proposals based on current legislation regarding the management and activities of the University within its competence;
- To represent the University and protect its interests in state, private institutions, and courts;
- To be involved in the work of the election commission created for the purpose of holding elections for the University’s governing bodies and to provide legal support to the election commission;
- To participate in the development of drafts of contracts and legal acts to be prepared in individual structural units within the scope of the University’s activities and to carry out their legal expertise;
- To bring the University’s legal acts into compliance with the current legislation of Georgia;
- To inform the University’s structural units about legislative changes and to monitor the process of implementing these changes at the University;
- To provide legal consultations to University employees and students;
- To prepare responses to letters and applications received at the University as instructed by the University Rector and Head of Administration;
- To conduct legal expertise of responses and correspondence prepared by the University’s structural units;
- To endorse individual administrative-legal acts prepared regarding the University’s personnel and financial matters.
- In fulfilling its assigned functions and objectives, the Department is authorized to:
- Prepare drafts of legal acts within its competence, develop proposals for introducing changes and additions to legal acts, or for their partial or complete annulment;
- Carry out legal expertise and endorsement, and/or prepare conclusions based on legal expertise regarding drafts of legal acts developed and submitted by the University and other bodies, organizations, and institutions within its competence;
- Represent the University in state institutions and courts of all instances based on the conferral of representative authority by the University Rector and the Head of Administration.
Chapter III. Structure and Leadership of the Department
Article 3. Structure of the Department
- The Department is headed by the Head of the Department. The Head of the Department has a Deputy.
- The positions defined for the Department in the University’s staffing schedule are: Head of the Department, Deputy Head of the Department, Lawyer, and Senior Specialists.
- The Head of the Department is appointed and dismissed by the Head of Administration in agreement with the University Rector.
- The Deputy Head of the Department and employees are appointed and dismissed by the University’s Head of Administration upon the recommendation of the Head of the Department.
- In the temporary absence of the Head of the Department (vacation, business trip, illness, temporary absence for more than 2 days), as well as in the case of a task from the Head of the Department, their duties are performed by the Deputy Head of the Department.
- The functions of the Department’s Senior Specialists are defined by their job descriptions.
- The Head of the Department is accountable to the University Rector and the Head of Administration.
- The Deputy Head of the Department, the Lawyer, and Senior Specialists are accountable to the Head of the Department.
Article 4. Head of the Department
- Manages and directs the activities of the Department;
- Represents the Department in the exercise of assigned rights and obligations and is responsible for the fulfillment of the functions and objectives assigned to the Department;
- Endorses documents prepared in the Department within their competence;
- Distributes correspondence received by the service;
- Allocates duties among the Department’s employees, and gives them instructions and assignments;
- Supervises the proper performance of official duties by the Department’s employees and monitors their compliance with the University’s internal regulations;
- Submits a report on the activities of the Department annually, as well as at any time upon the instruction of the University Rector and the Head of University Administration;
- Submits proposals to the Head of University Administration regarding the Department’s internal structure, staffing, work organization, and the encouragement or disciplinary action of Department employees;
- Issues conclusions on behalf of the service within their competence;
- Periodically listens to the report of the Department’s employees on the work they have done;
- Mediates for the allocation of funds, equipment, and inventory necessary to fulfill the functions and objectives facing the Department;
- Mediates for the professional development and retraining of Department employees;
- Develops drafts of contracts and legal acts to be prepared in individual structural units within the scope of the University’s activities and ensures their legal expertise;
- Participates in the consideration of applications received at the University within their competence and prepares a corresponding legally substantiated conclusion;
- Ensures that the University’s legal acts are brought into compliance with the current legislation of Georgia, that the University’s structural units are informed about legislative changes, and that the process of implementing these changes at the University is monitored;
- Exercises other powers defined by this Regulation, the University’s legal acts, and the legislation of Georgia;
- Performs tasks related to the Department’s activities from the Head of Administration and the Rector.
Article 5. Deputy Head of the Department
The Deputy Head of the Department, within their competence:
- Assists the Head of the Department in planning, coordinating, and organizing the fulfillment of their assigned duties;
- Participates in the distribution of materials received by the Department;
- Studies and analyzes the legislative framework operating in the field of University management and prepares proposals and drafts of relevant legal acts for its improvement;
- Provides legal consultations to the University’s structural units on official matters;
- Performs tasks related to the Department’s activities from the Head of Administration, the Rector, and the Head of the Department;
- Performs other duties as assigned by the Head of Administration, the Rector, and the Head of the Department.
Article 6. University Lawyer
The University Lawyer, within their competence:
- Represents the University and protects its interests in state, private institutions, and courts;
- Provides legal consultations to University employees and students;
- Participates in the work of the election commission created to hold elections for the University’s governing bodies and provides legal support to the election commission;
- Participates in the work of the appeals commission, created in case of an appeal of the results of a corresponding competition held within the framework of the University’s (internal) sports tour, and provides legal support to the commission.
Chapter IV. Concluding Provisions
Article 7. Procedure for Introducing Changes and Additions to the Regulation
Changes and additions to the Department’s Regulation are made in accordance with the procedure established by the legislation of Georgia.
Article 8. Reorganization and Liquidation of the Department
The reorganization or liquidation of the Department is carried out in accordance with the procedure established by the legislation of Georgia.
